Sir,
With reference to above mentioned subject and also with respect
to the point no. 21 of the resolution forwarded by Sh. C.R.
Das, President, ASTO-Mumbai, dated 03.01.2007, I am enclosing
certain documents for your perusal.
Sir, a civil appeal was filed in Supreme Court way back in
1990 with respect to the criteria for deciding the “wholly
dependency” of family for an individual under the medical
rules. The civil appeal no. 1368 of 1990 was heard and the
judgment was delivered in 1997. The copy of the judgment is
enclosed for your perusal. The conclusion of the court was
that the family of an individual shall be treated as wholly
dependant on the employee irrespective of the pension being
drawn by the father of the employee.
This Supreme Court decision has been implemented in number
of PSUs now and a copy of the circular of NTPC is also enclosed
for your ready reference.
It is requested that the same may be implemented for ONGC
also.
